You’ve Been In A Car Accident. Who Pays To Get Your Car Repaired?

You’ve Been In A Car Accident. Who Pays To Get Your Car Repaired?

You’ve been in an accident and your car needs to be repaired or replaced. Who pays for the damage to my car? How do I make that happen? And how am I going to get around while my car is being repaired?

Here’s Your Injury Law Group’s Guide to Getting Your Car Repaired After an Accident:

  • Getting your car repaired or replaced: There are different options as to who will be paying for the damage to your car, depending on who was at fault in the accident and what type of insurance they and you have.
  • The other owner’s/driver’s insurance company: If the other owner/driver was at fault and their insurance company accepts responsibility for the accident, you/your lawyer can process your claim through the at-fault owner’s or driver’s insurance company. For this you will be relying upon the owner/driver’s Property Damage Liability insurance coverage. This coverage, known as ‘PD coverage,’ pays for the damage to your vehicle and other property resulting from the other owner’s/driver’s negligence. As PD coverage is among the minimum insurance coverages required in Florida, the other owner’s/driver’s auto insurance should include this coverage.
  • Your own insurance company: But what happens if the other insurance company claims it was not their insured’s fault, or if the other owner/driver didn’t have insurance, or if the accident was your own fault? Depending on the type of insurance coverages you had in place, you may be relying upon your own insurance company to repair or replace your car. If you had Comprehensive and Collision coverage, your insurance company may be held responsible for the damage to your car, regardless of who was at fault.
  • What if the other driver was at fault but their insurance company refuses to pay for the damage to your car? Insurance companies make their own determination of what they will or will not cover. But their determinations are not necessarily binding on you, the party damaged by their insured’s negligence. If you do not agree with their determination, there are ways to challenge those determinations. An experienced attorney can guide you through this process. • How to deal with the insurance companies? Dealing with insurance companies can be challenging and time consuming, often fraught with legal pitfalls. For example, are you obligated to give them a recorded or sworn statement? And what are the legal consequences of such a Statement? Can they require you to use their repair facility? What if the repairs cost more than they authorize? What about the diminished value of my car now that it has been in an accident? And how will I get around while my car is being repaired?

Our best suggestion is to let an experience lawyer deal with the insurance companies for you. An experienced insurance litigator (an attorney with experience suing insurance companies) can help you cut through the red tape while protecting and advancing your rights. At Your Injury Law Group, our team has litigated literally thousands of lawsuits against insurance companies, helping our clients recover millions of dollars more than the insurance companies had originally offered to pay!
